all accounts are settled or only a bond account is outstanding

Section 71 of the Act pertains to the issuance of a clearance certificate. For a clearance certificate to be issued, all the accounts that were included in the debt review (other than a home loan) must be settled. The issuance of the clearance certificate results in the removal of the debt review flag from the consumer’s credit report. Should a debt counsellor decide not to issue or fails to issue a clearance certificate, the consumer can apply to the National Consumer Tribunal to review the debt counsellor’s decision not to, or failure to, issue the clearance certificate. If the Tribunal is satisfied that the consumer is entitled to the clearance certificate, the Tribunal may order the debt counsellor to issue a clearance certificate to the consumer.
